Terms of Service

Welcome to The Coloring Post. These Terms of Service (“Terms”) are a legal agreement between you and Culture Media LLC (“The Coloring Post,” “we,” “us,” or “our”), which operates the website at thecoloringpost.com and the related email delivery service (together, the “Service”). By using the Service, creating a sample page, or subscribing, you agree to these Terms. If you do not agree, please do not use the Service.

These Terms include a binding arbitration provision and a class-action waiver in Section 13, which affect how disputes are resolved. You may opt out of arbitration within 30 days as described there.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to create an account or subscribe. The Service is intended for adults. Children do not interact with the Service directly. A parent, guardian, or caregiver may request pages on behalf of a child or another person, and by doing so you confirm you have the authority to provide any information you submit about that person.

2. What the Service does

You tell us a few details about who the page is for — such as a first name (optional), an age range, and a handful of interests — and we generate printable black-and-white coloring pages and deliver them to your email on the schedule you choose. Pages are created with the help of automated (AI) image generation. Each page is generated fresh, but because generation is automated, similar or comparable pages may be produced for you or for others, and we do not guarantee that any page will be unique, error-free, or suited to a particular purpose, nor any specific content, style, or outcome.

3. Your account

You are responsible for the information you provide and for activity associated with your email address. Keep your account details accurate, and let us know at contact@thecoloringpost.com if you believe your account or email has been misused.

4. Acceptable use

Our pages depict playful, imaginary scenes. They are not instructions, endorsements, or examples of safe real-world behavior, and nothing shown is a suggestion to attempt the activity depicted. Children should color, cut, and craft with adult supervision. Pages are drawn from a curated menu of interests and pass automated safety review; despite our safeguards, automated generation is imperfect, so if a page ever seems inappropriate, please stop using it and contact us. In addition, you agree not to:

Attempt to prompt, coax, or manipulate the Service into generating content that is sexual, violent, hateful, harassing, dangerous, or otherwise prohibited;
Use the Service to infringe anyone’s intellectual property, or to request trademarked or branded characters;
Resell, redistribute, sublicense, or commercially exploit the pages or the Service without our written permission;
Reverse-engineer, scrape, harvest, or use automated means to access or copy the Service, or attempt to circumvent its limits, safety checks, or rate limits;
Interfere with, probe, overload, or gain unauthorized access to the Service or its systems;
Use the Service in violation of any applicable law, or encourage others to do so.

We may investigate and take appropriate action, including removing content and suspending or terminating access.

5. Your pages, ownership, and AI output

Coloring pages you receive are licensed to you for your own personal, non-commercial use — printing, coloring, gifting, and enjoying them at home. You may not resell them or use them commercially without our written permission.

Because the pages are produced by automated (AI) image generation, please understand: works generated by artificial intelligence may not be eligible for copyright protection, and we make no representation that you (or we) own any copyright in a given page. We also do not warrant that a page is original, unique, or free of resemblance to other works, or that it does not infringe any third party’s rights. The Coloring Post name, logo, website, template designs, and underlying software remain our property, and nothing in these Terms grants you rights in them.

6. Subscriptions, billing, and auto-renewal

Free editions. New subscribers receive a limited number of free editions (currently the first 7) at no charge.
Paid plans. After the free editions, a paid subscription is $8 per month or $69 per year (prices in U.S. dollars, exclusive of any applicable taxes).
Automatic renewal. Paid subscriptions automatically renew at the end of each billing period (monthly or yearly) at the then-current price, and your payment method is charged automatically, until you cancel.
Cancellation. You can cancel at any time — cancellation is available with one click via the link in any edition email or by contacting us. Cancelling stops future charges; it takes effect at the end of the current paid period, and you keep access until then.
Payments. Payments are processed by Stripe. We do not receive or store your full card number. Your use of checkout is also subject to Stripe’s terms.

7. Refunds

Because editions are delivered as digital goods, our refund and cancellation terms are described in our Refund & Cancellation Policy, which is part of these Terms.

8. Privacy

Our Privacy Policy explains what we collect and how we use it, and is part of these Terms.

9. Copyright complaints

We create original characters and do not reproduce trademarked or branded characters. If you nonetheless believe a page infringes your copyright, email us at contact@thecoloringpost.com with a description of the work and where it appears, and we will review and, where appropriate, remove it. We may restrict accounts associated with repeated infringement.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. AI-generated pages may contain artifacts, imperfections, or unexpected results. The Coloring Post is not a medical, therapeutic, or educational treatment product, and pages are not a substitute for professional care of any kind. We do not warrant that the Service will be uninterrupted or error-free, or that any page will meet your expectations.

11. Limitation of liability

To the fullest extent permitted by law, Culture Media LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service or any coloring page. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred U.S. dollars (USD $100).

12. Indemnification

You agree to indemnify and hold harmless Culture Media LLC and its owners from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, the content you request, or your violation of these Terms or any law or third-party right.

13. Dispute resolution; arbitration; class-action waiver

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before starting a formal proceeding, you agree to contact us at contact@thecoloringpost.com and try in good faith to resolve the dispute for at least 30 days.
Binding arbitration. Except as noted below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. The arbitrator decides all issues, except that a court may decide the enforceability of this arbitration provision.
Class-action waiver. Disputes will be arbitrated only on an individual basis; you and Culture Media LLC waive any right to bring or participate in a class, collective, or representative action.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights.
30-day opt-out. You may opt out of this arbitration provision by emailing contact@thecoloringpost.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
Time limit. Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

14. Governing law and venue

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. To the extent a dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Connecticut, and you consent to their jurisdiction.

15. Changes

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify subscribers by email. Continued use after changes take effect means you accept the updated Terms.

16. General

These Terms, together with our Refund & Cancellation Policy and Privacy Policy, are the entire agreement between you and Culture Media LLC regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. We are not liable for delays or failures caused by events beyond our reasonable control. By using the Service you consent to receive communications from us electronically (by email and on the site). If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
